This method is applicable to the supervision and management of automatic monitoring systems for key pollution sources.
The construction, management, and operation maintenance of automatic monitoring systems for key source water pollutants, air pollutants, and noise emissions must comply with these measures.
Article 3: The automatic monitoring system referred to in these Measures consists of automatic monitoring equipment and a monitoring center.
Automatic monitoring equipment refers to instruments, flow meters, pollution control facility operation recorders, and data acquisition and transmission devices installed at the pollution source site for monitoring and monitoring pollutant emissions. It is an integral part of pollution prevention and control facilities.
The monitoring center refers to the computer software and equipment used by the environmental protection department to connect with automatic monitoring equipment through communication transmission lines for automatic monitoring of key pollution sources.
Article 4: If the automatic monitoring system passes the inspection and operates normally by the environmental protection department, its data shall be used as the basis for environmental supervision and management such as pollution declaration and verification, issuance of pollution permits, total quantity control, environmental statistics, collection of pollution fees, and on-site environmental law enforcement by the environmental protection department, and shall be made public to the society in accordance with relevant regulations.
Article 5: The State Environmental Protection Administration is responsible for guiding the automatic monitoring of key pollution sources nationwide, and formulating relevant work systems and technical specifications.
Local environmental protection departments, in accordance with the requirements of the State Environmental Protection Administration, determine the key pollution sources that need to be automatically monitored and develop work plans based on the principles of overall planning, ensuring key areas, considering general areas, and acting within their capabilities.
Article 6: Environmental supervision agencies are responsible for the following tasks:
(1) Participate in the development of work plans and organize their implementation;
(2) Verify whether the selection, installation, and use of automatic monitoring equipment meet the requirements;
(3) Supervise and inspect the construction, operation, and maintenance of automatic monitoring systems;
(4) Network monitoring and management of automatic monitoring systems for key pollution sources within this administrative region;
(5) Verify the automatic monitoring data and submit it online to the same level environmental protection department and higher-level environmental supervision agencies;
(6) Propose legal penalties for polluting units that fail to establish or dismantle, idle, close, or use automatic monitoring systems in accordance with regulations.
Article 7: Environmental monitoring agencies are responsible for the following tasks:
(1) Guide the selection, installation, and use of automatic monitoring equipment;
(2) Regularly compare and monitor automatic monitoring equipment, and provide opinions on the effectiveness of automatic monitoring data.
Article 8: Environmental information agencies are responsible for the following tasks:
(1) Guide the software development of automatic monitoring systems;
(2) Guide the networking of automatic monitoring systems and verify whether the networking of automatic monitoring systems complies with the technical specifications formulated by the State Environmental Protection Administration;
(3) Assist environmental monitoring agencies in maintaining and managing the networked operation of automatic monitoring systems.
Article 9: Any unit or individual has the obligation to protect the automatic monitoring system and has the right to report any abnormal use of the automatic monitoring system, such as idle, dismantled, damaged, or unauthorized modification of its parameters and data.
Chapter 2 Construction of Automatic Monitoring System
Article 10: Polluting units included in the pollution source automatic monitoring plan shall construct and install automatic monitoring equipment and its supporting facilities within the prescribed time limit, and cooperate with the networking of the automatic monitoring system.
Article 11: New construction, renovation, expansion, and technological transformation projects shall construct and install automatic monitoring equipment and its supporting facilities in accordance with the requirements of the approved environmental impact assessment documents. As an integral part of environmental protection facilities, they shall be designed, constructed, and put into use simultaneously with the main project.
Article 12: The construction of an automatic monitoring system must meet the following requirements:
(1) The relevant instruments in automatic monitoring equipment should be selected from products that have been tested for suitability by the environmental monitoring instrument testing agency of the State Environmental Protection Administration;
(2) The data collection and transmission comply with the technical specifications for data transmission and interface standards of the national pollution source online automatic monitoring system;
(3) Automatic monitoring equipment should be installed at sewage outlets that comply with environmental protection regulations;
(4) According to relevant national environmental monitoring technical specifications, the comparative monitoring of environmental monitoring instruments should be qualified;
(5) The automatic monitoring equipment and monitoring center can be stably connected to the network;
(6) Establish a system for the operation, use, and management of automatic monitoring systems.
Article 13: The construction, operation, and maintenance funds for automatic monitoring equipment shall be self raised by the polluting units, and the environmental protection department may provide subsidies; The construction, operation, and maintenance funds of the monitoring center shall be budgeted and applied for by the environmental protection department.
Chapter 3 Operation, Maintenance and Management of Automatic Monitoring System
Article 14: The operation and maintenance of automatic monitoring systems shall comply with the following provisions:
